Indian Penal Code, 1860 (45 of 1860), Section 406, 420 – Dowry Prohibition Act, 1961, (28 of 1961), Section 3, 4 – Code of Criminal Procedure, 1973 (2 of 1974), Section 438 – Anticipatory bail -- Respondent granted anticipatory bail subject to deposit of Rs. 75,000/- on offer made by him – Co-accused paid Rs.6,00,000/- to the petitioner to get concession of bail – Held, process of criminal law cannot be utilised for arm-twisting and money recovery, particularly while opposing the prayer for bail -- Recovery of money is essentially within the realm of civil proceedings – Criminal proceedings are being prosecuted only as money recovery proceedings -- Hence, the order granting pre-arrest bail to the respondents stands affirmed but, the condition therein, of payment of Rs.75,000/- by the respondent No.2, stands annulled.
