Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985), Section 22, 25, 37 – Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023), Section 483 – Constitution of India, Article 21 -- NDPS – Commercial quantity – Regular Bail – Rigors of Section 37 of NDPS Act – Delay in trial – Effect of -- Petitioner in custody for the last 01 year 11 months and 09 days and only 04 of the 12 prosecution witnesses have been examined so far – Petitioner is first-time offender with no other case registered against him -- Rigors of Section 37 of the NDPS Act can be diluted to an extent in view of the salutary provisions of Article 21 of the Constitution of India which provides for the right to a speedy trial -- Case of the petitioner can be considered for the grant of bail, moreso as the co-accused has already been granted the same concession – Bail allowed.
