Indian Penal Code, 1860 (45 of 1860), Sections 307, 458, 324, 323, 427, 148, 149 (Sections 325/326 IPC added later on) – Code of Criminal Procedure, 1973 (2 of 1974), Section 438 -- Attempt to murder – Lalkara -- Anticipatory bail -- Petitioner is attributed a 'lalkara' only although the other co-accused are alleged to have caused injuries – Interim bail given, petitioner has joined the investigation to the satisfaction of the Investigating Officer and even challan has been presented to Court – Interim order made absolute.

RAJ MOHAN SINGH, J. (ORAL) –
1. The case has been taken up for hearing through video conferencing.
2. Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.0043 dated 07.07.2020 under Sections 307, 458, 324, 323, 427, 148, 149 IPC (Offence under Sections 325/326 IPC added later on) registered at Police Station Bajakhana, District Faridkot.
3. Notice of motion was issued on 07.08.2020 by passing the following order:-
“The learned counsel for the petitioner submits that the petitioner is attributed a 'lalkara' only although the other co-accused are alleged to have caused injuries.
Notice of motion for 15.12.2020.
Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to her furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.”
4. Petitioner is alleged to have raised lalkara. Offences under Sections 325/326 IPC were added later on. The aforesaid offences have been allowed to be incorporated in the petition vide order dated 16.10.2020.
5. Learned State counsel on instructions from ASI Balraj Singh submits that the petitioner has joined the investigation to the satisfaction of the Investigating Officer and even challan has been presented to Court.
6. In view of above, order dated 07.08.2020 is hereby made absolute.
Order accordingly.
