Haryana Chowkidar (Watchman) Rules, 2011 – Haryana Land Revenue Act, 1887 (XVII of 1887), Section 13 -- Appointment of village chowkidar – Appeal against -- Rules do not provide for remedy of an appeal, but order passed by the Collector who is a revenue officer and thus, appeal can be filed under the 13 of the Act, 1887.

SUDHIR MITTAL, J. (ORAL) –
1. Respondent No.5 was appointed as Chowkidar vide order dated 25.03.2022 passed by respondent No.2. Allegedly, an appeal was preferred thereagainst, but the same has been returned on the ground that the Haryana Chowkidar (Watchman) Rules, 2011 do not provide for remedy of appeal.
2. The aforementioned Rules do not provide for remedy of an appeal, but order dated 25.03.2022 is an order passed by the Collector who is a revenue officer and thus, appeal can be filed under the 13 of the Punjab Land Revenue Act, 1887.
3. Learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to file an appeal as stated hereinabove.
4. Dismissed as withdrawn with the aforementioned liberty. In case, there is an objection regarding limitation, the same shall be considered sympathetically.
Petition dismissed.
