RAJ MOHAN SINGH, J. (ORAL) –
1. The petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus directing the respondents to count his work charge service from 1968 to 1974 for the purpose of pensionary benefits.
2. In the written statement filed by the respondents No.4 and 6, it has been submitted that the answering respondents are not averse to consider the period of work charge service attended by the petitioner as qualifying service for the purpose of retiral benefits. The respondents No.4 and 6 are ready to add the period of work charge service rendered by the petitioner in his qualifying service and process the same to revise his pension/PPO after due formalities are completed by the petitioner i.e. production of an office order from respondent No.5 regarding the period of work charge service rendered by the petitioner in respondent No.5-Nigam. Production of an office order from the respondent No.5 would enable the competent authority to grant the aforesaid relief.

Precisely for the said requirement, this Court vide order dated 14.12.2022 directed the respondents to file an affidavit of respondent No.5 with regard to the period of work charge service rendered by the petitioner in the said respondent No.5-Nigam. In compliance of the aforesaid directions, the respondent No.5 has filed an affidavit of Pardeep Kumar, XEN, OP Division, Uttar Haryana Bijli Vitran Nigam Limited, Jhajjar, endorsing that the period of work charge service rendered by the petitioner under the respondent No.5 has been from 30.08.1968 to 10.05.1974.

In the light of affidavit tendered by Pardeep Kumar, XEN, OP Division, Uttar Haryana Bijli Vitran Nigam Limited, Jhajjar, this writ petition is disposed of by directing the respondents No.4 and 6 to consider the work charge period from 30.08.1968 to 10.05.1974 for the purpose of re-fixation of pension and other retiral benefits.
5. In view of the aforesaid facts, this writ petition is disposed of .
6. Let needful be done within two months from the date of receipt of certified copy of this order.
Order accordingly.
