Code of Criminal Procedure, 1973 (2 of 1974), Section 427 -- Negotiable Instruments Act, 1881 (26 of 1881), Section 138 -- Cheque bounce case – Singular transaction -- Concurrent running of sentence -- Loan of Rs.5 lacs each on two different dates – Two transactions, though undertaken at different points of time, to be deemed as a singular transaction or two segments of one transaction -- Imperative essentiality of a single transaction as the decisive factor to enable the Court to direct the subsequent sentence to run concurrently with the previous one -- Direction for concurrent running of sentence would be limited to the substantive sentence alone – Substantive sentences of 10 months simple imprisonment awarded to the appellant in the two complaints would run concurrently – Default sentences, if the fine by way of compensation, as imposed, has not been paid by him would run consecutively.
