Negotiable Instruments Act, 1881 (26 of 1881), Section 138 -- Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023), Section 528 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 82, 482 – Cheque bounce complaint -- Jump of bail – Proclaimed person – Primary object of every Court is only to examine the commission of crime in question before it viz-a-viz the person/ accused, who is subjected to such proceedings, and if possible justice be imparted at the earliest without unnecessary delay -- Not expected that undue time would be devoted in securing the presence of absconded accused and also to waste energy by enforcing the special mechanism to arrest such accused -- When the petitioner came to know about passing of the impugned order, the petitioner immediately moved the petition, showing his inclination to submit himself before the trial Court – Impugned order set aside to the extent of declaring the petitioner as ‘proclaimed person’ -- Petitioner ordered to be released on bail.
