Punjab Excise Act, 1914 (Punjab Act 1 of 1914), Sections 61/1/14 – Code of Criminal Procedure, 1973 (2 of 1974), Section 438 – Excise matter – Anticipatory bail – Interim bail on contention that the allegations against the petitioner are that 60 bottles of country made liquor for sale in Chandigarh were recovered from his house – He also contends that the petitioner is not involved in any other case under the Excise Act – Petitioner has joined the investigation and is not required for any further investigation – Interim bail granted to the petitioner is made absolute.

1. Prayer in this petition is for grant of anticipatory bail in FIR No.369 dated 18.10.2019 under Sections 61/1/14 of Excise Act, 1914, registered at Police Station Phillaur, District Jalandhar.
2. While granting interim bail to the petitioner, following order was passed by this Court on 21.11.2019: -
“...Learned counsel for the petitioner contends that the allegations against the petitioner are that 60 bottles of country made liquor for sale in Chandigarh were recovered from his house. He also contends that the petitioner is not involved in any other case under the Excise Act...”
3. Learned counsel for the petitioner submits that in pursuance of the aforesaid order, the petitioner has joined the investigation and is not required for any further investigation.
4. Learned State counsel, on instructions from HC Jai Gopal, has not disputed the factual position and states that the petitioner is no more required for any further investigation.
5. In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 21.11.2019 is made absolute subject to the conditions envisaged under Section 438 (2) Cr.P.C.
Petition allowed.
