Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985), Section 15 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 439 -- NDPS case -- Interim bail for cremation and last rights of wife – Recovery of 55 kg poppy husk – One more case against the petitioner under Indian Penal Code, 1860 – No danger or disturbance of peace in case the petitioner is released on interim bail -- Petitioner is directed to be released on interim bail for a period of 15 days -- On completion of period of 15 days, the petitioner shall surrender before the concerned authorities.

ANIL KSHETARPAL, J. (ORAL) –
1. The hearing of the case was held through video conferencing on account of restricted functioning of the Courts.
2. The petitioner prays for release on interim bail for a period of 15 days in order to perform cremation and final rites of his wife Late Smt. Karamjit Kaur, who died on 04.07.2021. The petitioner is alleged to have been apprehended with 55 kg poppy husk.
3. As per the case of the prosecution, there is one more case against the petitioner under Indian Penal Code, 1860.
4. Sh. V.G.Jauhar, Sr. DAG, Punjab, has filed a status report under the signature of the concerned Station House Officer, Police Station Sadar, Faridkot, wherein it has been pointed that there is no danger or disturbance of peace in case the petitioner is released on interim bail.
5. Keeping in view the aforesaid facts and without commenting upon the merits of the case, the petitioner is directed to be released on interim bail for a period of 15 days, subject to his furnishing bail bonds with surety of the like amount, subject to the satisfaction of the concerned trial court/Illaqa Magistrate. Let efforts be made to release the petitioner on interim bail today itself. It is also directed that on completion of period of 15 days, the petitioner shall surrender before the concerned authorities.

7. All the pending miscellaneous applications, if any, also stand disposed of.
