Indian Penal Code, 1860 (45 of 1860), Sections 306, 34 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 438 – Abetment to suicide – Anticipatory bail – Compromise between parties -- Complainant has already executed an affidavit endorsing the factum of settlement between the parties and he does not wish to pursue the case anymore – On interim bail petitioner has joined the investigation to the entire satisfaction of the Investigating Officer – Petitioner is no more required for further investigation of the case -- Interim order made absolute -- Petition disposed of.

RAJ MOHAN SINGH, J. (ORAL) –
1. The case has been taken up for hearing through video conferencing.
2. Petitioner seeks grant of anticipatory bail in case bearing FIR No.199 dated 09.08.2020 registered under Sections 306 and 34 IPC at Police Station Kathunangal, District Amritsar.
3. On 10.12.2020, following order was passed by this Court:-
“The case has been taken up for hearing through video-conferencing.
Learned counsel for the petitioner relies upon order dated 04.12.2020 passed in CRM-M-33217 of 2020 titled Prabhjot Kaur vs. State of Punjab to contend that the petitioner is sister of Prabhjot Kaur. Even otherwise, complainant Hazara Singh has already executed an affidavit on 27.11.2020 endorsing the factum of settlement between the parties and he does not wish to pursue the case any more.
Notice of motion for 28.01.2021.
In the meanwhile, petitioner is directed to appear before the SHO/Investigating Officer to join investigation on 17.12.2020 at 11.00 a.m. and in the event of her arrest, she shall be enlarged on ad interim bail, on her furnishing requisite bail bonds/surety bonds subject to the satisfaction of Arresting Officer. However, petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.”
4. Learned counsel for the petitioner submitted that in compliance of the aforesaid order, the petitioner has joined the investigation to the entire satisfaction of the Investigating Officer.
5. Learned State counsel on instructions from ASI Baljit admitted the aforesaid fact and submitted that the petitioner is no more required for further investigation of the case.
6. In view of aforesaid factual position, the interim order dated 10.12.2020 is made absolute. Petitioner shall keep on joining the investigation as and when required to do so and she shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.
7. Petition stands disposed of.
Order accordingly.
