Code of Civil Procedure, 1908 (V of 1908), Order 7 Rule 11, Order 21, Section 11 -- Rejection of plaint -- Decree for specific performance -- Maintainability of independent suit by person claiming to be in possession – Limitation -- If the Plaintiff claim to be in possession of the suit land, she could have filed the objections under Order 21 CPC before the Executing Court in the execution filed by the decree holder -- In fact, plaintiff filed the objections before the Executing Court and the same were dismissed by the Executing Court – Sale deed was executed in September, 1995, whereas the suit filed for seeking declaration and mandatory injunction in July, 2014 -- Plaint is liable to be rejected on account of concealment of material facts about previous litigation and resjudicata and bar of limitation -- Independent suit was not maintainable in view of Order 21 CPC -- Order of Trial Court rejecting the paint restored.
