Supreme Court of India
Decided on: 03.01.2025

Arbitration Act, 1940 (10 of 1940), Section 14(2), 17 -- Limitation Act, 1963 (36 of 1963), Article 119(b) – Arbitration award -- Limitation for filing objections – Starting date -- The trigger for the limitation to start running is the date of service of notice of the filing of the award –  Word ‘notice’ is that the parties merely reach a state of awareness about the award and plan their next steps accordingly, and not the imposition of another procedural step -- Date of receiving a copy of the award is not the requirement of Section 14(2), but merely awareness that it is available to the parties -- This holding signifies that the parties have to take steps to scrutinise the award themselves -- Any contrary interpretation will give a licence to the award-debtor to delay the arbitration by insisting on procedural nuances despite of being aware that an award exists and that its contents are accessible to it.
