Passports Act, 1967 (15 of 1967), Section 10(3)(b) – Constitution of India, Article 14, 21 -- Indian Penal Code, 1860 (45 of 1860), Sections 498-A, 323, 406, 506 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 82 -- FIR registered u/s 498-A, 323, 406, 506 IPC – Proclaimed offender – Seizure of passport – Fundamental right to travel abroad -- Petitioner was declared a proclaimed offender, when the petitioner was in New Zealand on a valid visa – Thereafter, High Court stayed his arrest for a period of 08 weeks -- On arrival from New Zealand, the passport of the petitioner was seized and later, he had appeared before the trial Court and was granted bail – Impounding of the passport is violative of Articles 14 and 21 of the Constitution of India -- Petition allowed, seizure memo set aside.
