Punjab Village Common Lands (Regulation) Act, 1961 (18 of 1961), Section 11, 13 – Code of Civil Procedure, 1908 (V of 1908), Order 7 Rule 11, Section 9 – Common land -- Title dispute – Jurisdiction of Civil court -- Plaint rejected as the plaintiffs sought a decree of declaration that the various orders passed by the authorities while deciding the suit u/s 11 of the 1961 and other orders are illegal, null and void -- Section 13 of the 1961 Act specifically bars the jurisdiction of the Civil Court with respect to the correctness of the orders passed by the authorities nominated under the 1961 Act – No ground to interfere is made out.

ANIL KSHETARPAL, J. (ORAL) –
1. While allowing the application under Order 7 Rule 11 CPC, the Court has rejected the plaint as the plaintiffs sought a decree of declaration that the various orders passed by the authorities while deciding the suit under Section 11 of the Punjab Village Common Lands (Regulation) Act, 1961 (hereinafter referred to as 'the 1961 Act') and other orders are illegal, null and void. Section 13 of the 1961 Act specifically bars the jurisdiction of the Civil Court with respect to the correctness of the orders passed by the authorities nominated under the 1961 Act.
2. Keeping in view the aforesaid facts, no ground to interfere is made out.
3. Dismissed.
4. All the pending miscellaneous applications, if any, are also disposed of.
Petition dismissed.
