Negotiable Instruments Act, 1881 (26 of 1881), Section 138, 142(2)(a) – Cheque bounce complaint – Territorial jurisdiction -- Appellant maintains his bank account in Mangalore – He merely deposited the respondent’s cheques at its Mumbai Branch for the purpose of crediting his account in Mangalore -- Offence u/s 138 of NI Act should be inquired into and tried only by a Court within whose local jurisdiction, branch of the bank where the payee maintains the account is situated -- Appellant was fully justified in filing his complaint cases before the jurisdictional Court at Mangalore.
