Indian Penal Code, 1860 (45 of 1860), Section 302 – Constitution of India, Article 136 -- Murder – Judicial discipline and propriety -- Conviction upheld by Supreme Court, matter remanded back to High Court to consider the question of sentence, after hearing the learned Senior Advocate on behalf of the accused – In paragraph 42 of the impugned judgment and order certain unwarranted observations made by High Court -- Judicial discipline requires that once the conviction was confirmed by Supreme Court that too after hearing the accused, the High Court should not have thereafter made any comment on the merits of the case – High Court commuted the death penalty to life imprisonment after considering the aggravating and mitigating circumstances – Paragraph 42 of the impugned judgment and order passed by the High Court set aside and expunged -- Commuting the death penalty to life imprisonment not interfered with.
