Punjab Pre-emption Act, 1913 (1 of 1913), Sections 3(1) (2) and (3), 8, 15, 16 -- General Clauses Act, 1897 (10 of 1897), Section 3(26) – Suit for Pre-emption right – Immovable property – Trial Court decreed the suit, upheld by High Court -- Immovable property is more than the land on which certain construction has been made --  As the notification dated 08.10.1985 limits its application for taking away the right of pre-emption only with reference to sale of land falling in the areas of any municipality, the same will not come to the rescue of the appellants/ purchaser -- Admittedly it is sale of immovable property, rolling mill had already been set up on the land, which was in occupation of the respondents as tenants.
