(2025) Law Today Live Doc. Id. 19929 = 2025 INSC 202
Decided on: 06.02.2025
Indian Penal Code, 1860 (45 of 1860), Section 448, 506 – Code of Criminal Procedure, 1973 (2 of 1974), Section 482 -- Criminal intimidation – House trespass – Quashing of FIR -- Allegations in the FIR are totally absurd -- When complainant has not filed any suit, there is no question of appellants threatening him of dire consequences if he does not withdraw the suit – Complainant and his relatives are in the habit of filing false and malicious cases against the appellants only on account of long-standing civil dispute pending between them – Continuation of the criminal proceedings against the appellants would be nothing else but an abuse of the process of law – Chargesheet and summoning order quashed and set aside.
