Motor Vehicles Act, 1988 (59 of 1988), Section 166 – Compensation in motor vehicle accident case -- Permanent functional disability – Functional disability -- 48% permanent disability to the right lower limb -- Assessment of compensation under the head of loss of future earning would depend upon the affected impact of such disability on the earning capacity of the claimant – It is not forthcoming from the award of the tribunal or the impugned judgment as to the corresponding functional disability – As per almanco manual, the whole body disability when compared to the particular limb disability would be 1/4th in respect of that of the lower limb -- Lower limb disability 48% and 1/4th of the same would be 12% -- Considering the income of the claimant at Rs.18,972/-, compensation that becomes payable to the claimant for loss of future earnings would be 18,972 x 12 x 17 x 12% = Rs.4,64,434.56/- -- Total compensation assessed at Rs. 9,06,100/- with interest of 9% per annum from the date of filing of the claim petition.
