Negotiable Instruments Act, 1881 (26 of 1881), Section 138 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 401 -- Constitution of India, Article 136 -- Cheque bounce case – Conviction of accused – Compromise at revisional stage – Compounding of offence – Lack of filing of compromise petition led the High Court to dismiss the Revision and confirm the conviction – Held, appellants cannot be convicted, as the settlement is nothing but a compounding of the offence – Respondent No.2 was duty bound to file a compromise petition before the High Court led to an unwarranted confirmation of the Appellants’ conviction – Appeals allowed and order of conviction set aside – It is kept open to the parties to settle their dispute as per the terms of the Memorandum Of Understanding.
