Punjab Excise Act, 1914 (Punjab Act 1 of 1914), Section 61/1/14 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 438 – Excise matter – Anticipatory bail – Ad-interim bail was granted on the contention that FIR registered on the basis of secret information, 720 bottles of country made liquor were recovered from the fodder room which belongs to the petitioner and he is not involved in any other case – Petitioner has joined the investigation, and he is no more required for further investigation – Interim bail order made absolute.

RAJ MOHAN SINGH, J. (ORAL) –
1. On 12.12.2017, following order was passed:-
“The petitioner is seeking anticipatory bail in FIR No.101 dated 26.11.2017 under Sections 61/1/14 of Excise Act, registered at Police Station Sadar Budhlada, District Mansa.
Learned counsel for the petitioner contends that the allegations against the petitioner in the FIR, which is registered on the basis of secret information, are that 720 bottles of country made liquor were recovered from the fodder room which belongs to the petitioner. He further contends that the petitioner is not involved in any other case.
Issue notice to the respondent, returnable on 23.01.2018.
In the meantime, petitioner is directed to appear before the Investigating Officer and join investigation.
In the event of his arrest, the Investigating Officer/Arresting Officer shall release the petitioner on ad-interim bail subject to his/her satisfaction. The petitioner shall join investigation as and when called upon to do so and he shall remain bound by the conditions envisaged under Section 438(2) Cr.P.C.”
2. Learned counsel for the petitioner stated that petitioner has joined the investigation.
3. This fact has not been disputed by learned State Counsel on instructions from ASI Jit Singh and stated that petitioner is no more required for further investigation.
4. In view of above, order dated 12.12.2017 is made absolute.
5. Petition stands disposed of.
Order accordingly.
