A. Protection of Children from Sexual Offences Act, 2012 (32 of 2012), Section 7, 8 -- Juvenile Justice (Care and Protection of Children) Rules, 2007, Rule 12 – POCSO case – Age of victim – Determination of – Stage of case -- Proof or determination of age of the victim in a POCSO case is foundational and for such an important issue, the same can be raised at any stage of the lifetime of the case, even before the appellate forum -- Impugned judgment and sentence set aside and quashed -- Matter remanded to the court of the learned Special Judge (POCSO), to determine the age of the victim and to pass the final order upon appreciation of evidence under the changed circumstances.

Protection of Children from Sexual Offences Act, 2012 (32 of 2012), Section 7, 8 -- Juvenile Justice (Care and Protection of Children) Rules, 2007, Rule 12 – Age of the victim – Determination of -- Nothing on record to indicate the actual age of the victim either by medical or documentary evidence -- Special Court directed to take up the exercise of determination of the age of the victim in accordance with Rule 12 of the Juvenile Justice (Care and Protection of Children) Rules, 2007 and to allow the parties to produce relevant documents, examine and cross-examine the witnesses and to be heard on the issue and thereafter to decide on the issue.
