Indian Penal Code, 1860 (45 of 1860), Section 379-B, (Sections 393 and 411 IPC added later on) – Code of Criminal Procedure, 1973 (2 of 1974), Section 438 – Snatching case – Jump in bail -- Anticipatory bail -- Petitioner had earlier been granted regular bail by the trial Court, but he had absented once as he had noted the wrong date and consequently his bail was cancelled – Petitioner undertakes that the he shall henceforth appear before the Court on each and every date of hearing and would not absent himself except without prior permission of the Court – Petitioner has surrendered before the trial Court and has been released on interim bail -- Order granting interim bail to petitioner is made absolute.

1. Case taken up through video conferencing.
2. The petitioner is seeking anticipatory bail in FIR No. 125 dated 14.11.2017, under Section 379-B of the Indian Penal Code, 1860 (‘IPC’ – for short) (Sections 393 and 411 IPC added later on), registered at Police Station Hariana, District Hoshiarpur.
3. Learned counsel for the petitioner contends that the petitioner had earlier been granted regular bail by the trial Court, but he had absented once as he had noted the wrong date and consequently his bail was cancelled. Thereafter, the petitioner had preferred a petition bearing No. 35126 of 2019 for anticipatory bail and by order dated 27.09.2019 this Court had granted him anticipatory bail and had directed him to appear before the trial Court. He also contends that the petitioner had been appearing before the trial Court regularly in terms of order dated 27.09.2019, but he could not appear on 19.02.2020, as he had been arrested in another FIR and consequently, his bail was cancelled. He undertakes that the petitioner shall henceforth appear before the Court on each and every date of hearing and would not absent himself except without prior permission of the Court.
4. This Court, by the order dated 08.01.2021, had directed petitioner to surrender before the trial Court and in the event of his doing so, he was ordered to be released on interim bail on his furnishing bail/surety bonds to the satisfaction of the trial Court.
5. Learned counsel for the petitioner states that petitioner has surrendered before the trial Court on 14.01.2021 and has been released on interim bail.
6. In view of the above, the order dated 08.01.2021 granting interim bail to petitioner is made absolute.
7. The petition stands disposed of.
Order accordingly.
