Indian Penal Code, 1860 (45 of 1860), Section 306 -- Code of Criminal Procedure, 1973 (2 of 1974), Section 482 – Abetment of suicide – Quashing of FIR/ Police report -- Illicit relationship of spouse -- Feeling upset or harassed on account of the illicit relations of a spouse and thereby committing suicide, in the absence of any positive act on the part of such spouse would not constitute abetment -- Apparently, a person of ordinary prudence would not have committed suicide in similar circumstances but the deceased did due to his hypersensitive nature -- FIR and the report u/s 173(2) Cr.P.C. clearly do not disclose the commission of any offence by the petitioners -- FIR, the report under Section 173(2) Cr.P.C. and all subsequent proceedings arising therefrom stand quashed.
