1. The present petition is filed under Section 439 Cr.P.C. seeking grant of regular bail in FIR No.66 dated 2.3.2020 registered under Sections 302, 120-B, 34 of IPC (Sections 201, 411, 115 of IPC added subsequently) and Section 25 of the Arms Act, 1959 at Police Station Hisar Civil Lines, District Hisar.
2. Admittedly, the only allegation against the petitioner is that he was handed over the weapon after the incident was over and that too by the main accused while the petitioner was in his own house. Co-accused, Sushil @ Bhalu from whom the motorcycle, on which the main accused was riding, was purchased has since been granted bail vide order dated 1.7.2020.
3. In view of the above, the present petition is allowed and the petitioner is released on bail to the satisfaction of the concerned Chief Judicial Magistrate/Duty Magistrate.
Petition allowed.
