Limitation Act, 1963 (36 of 1963), Section 5 -- Code of Civil Procedure, 1908 (V of 1908), Section 96 -- Decree – Delay in filing appeal – Condonation of delay -- Limitation would run from the date of passing of the decree and not from any date prior to passing of the same – Seeker of condonation of delay is not required to explain the period of his absence during the trial, what is required is the period of delay which runs as per the Limitation Act and in this case the period of limitation had started from the date of decree, therefore, any delay after explaining of such limitation was only to be explained by the appellant.
