Family Courts Act, 1984 (66 of 1984), Section 6, 9, 12 -- Family Courts (Procedure) Rules, 1992 (Delhi), Rule 8(viii) – Code of Civil Procedure, 1908 (V of 1908), Section 89 – Arbitration and Conciliation Act, 1996 (26 of 1996), Section 75, 81 -- Delhi High Court Mediation and Conciliation Rules, 2004, Rule, 20 -- Custody of child -- Mediation / Conciliation – Confidentiality of – Requirement of – Paramount consideration ought to be to see what is in the best interest of the child -- Complete adherence to confidentiality would absolutely be correct in normal matters where the role of the court is purely of an adjudicator -- But such an approach may not essentially be conducive when the court is called upon and expected to discharge its role in the capacity as parens patriae and is concerned with the welfare of a child.
