Haryana Co-operative Societies Act, 1984 (22 of 1984), Section 30 – Constitution of India, Section 226 -- Election of office bearers – Non-holding of – Writ petition -- Elections of the members of the Managing Committee held on 21.08.2022 but the elections of the office bearers not conducted so far which has to take place within 60 days of the election of the Managing Committee – Petition disposed of with a direction to respondent No.2 to consider and decide the legal notice within a period of 15 days.

1. The petitioner is seeking a direction to the respondents to conduct the election of the office bearers.
2. Learned counsel for the petitioner contends that although the elections of the members of the Managing Committee have taken place on 21.08.2022 but the elections of the office bearers has not been conducted so far which has to take place within 60 days of the election of the Managing Committee as per Section 30 of the Haryana Cooperative Societies Act, 1984. He also submits that the petitioner has sent a legal notice to the respondents in this regard (Annexure P-3) and prays that the petition may be disposed of with a direction to the respondents to consider and decide the same in accordance with law.
3. Issue notice to the respondents.
4. At the asking of the Court, Mr. Anant Kataria, DAG, Haryana accepts notice on behalf of the respondents.
5. Heard.
6. The petition is disposed of with a direction to respondent No.2 to consider and decide the legal notice (Annexure P-3) within a period of 15 days from the date of receipt of certified copy of this order.
