A. Limitation Act, 1963 (36 of 1963), Section 27, Article 65 -- Adverse possession – Permissive possession -- Hostile possession -- A person in permissible possession over the suit land cannot become owner only on the basis of long possession -- However, in case the said person starts proclaiming to be owner to the knowledge of the true owner, even if his possession in the beginning was permissive, it will become adverse, the moment he starts proclaiming to be in hostile possession.

B. Limitation Act, 1963 (36 of 1963), Section 27, Article 65 -- Adverse possession – Permissive possession -- Hostile possession -- Sale by attorney when owner already died – Moment the sale deeds in favour of defendants executed by the attorney of the owner, became null and void, on account of the fact that owner had already expired, the possession of the defendants became hostile, as they no longer could be stated to be in permissive possession on the basis of the prior mortgage -- Defendants were still continuing to be in possession on the basis of these null & void sale deeds, they perfected their title on the expiry of statutory period of limitation, as their possession was open, continuous, hostile and adverse to the title to the true owners/natural heirs owner.
