Constitution of India, Article 21, 226 -- Live-in relationship – Life and liberty -- Police protection -- Petitioner no.1/ Lady left the house of husband and living with petitioner no. 2 in live-in-relationship – Petition disposed of with a direction to Superintendent of Police to look into the matter and to dispose of the representation in accordance with law, in case there is a genuine threat to the lives and liberty of the petitioners, then necessary steps warranted under law be taken thereupon at the earliest so as to ensure that no harm is caused to the petitioners.

GURVINDER SINGH GILL, J. (ORAL) –
1. The petitioners have approached this Court seeking issuance of a direction to official respondents to protect their lives and liberty as they apprehend threat to the same at the hands of private respondents, who do not approve live-in relationship of the petitioners.
2. Learned counsel for the petitioners submits that petitioner No.1 was married to respondent No.4 and was also blessed with a child, but respondent No.4 has not been looking after petitioner No.1 and her child and has rather been harassing her on account of which she left her matrimonial home and is presently residing with petitioner No.2 in a live-in relationship.
3. Without commenting as regards the veracity of the averments made in the petition, the petition is disposed of with a direction to respondent No.2 i.e. Superintendent of Police, Fatehabad to look into the matter and to dispose of the representation dated 24.02.2021 (Annexure P-3) in accordance with law. In case, it is found that there is a genuine threat to the lives and liberty of the petitioners, then necessary steps warranted under law be taken thereupon at the earliest so as to ensure that no harm is caused to the petitioners.
4. A copy of this order alongwith copy of the representation dated 24.02.2021 be sent to the Superintendent of Police, Fatehabad (respondent No.2), so as to enable him to do the needful expeditiously.
5. It is, however, clarified that the aforesaid order shall not confer any immunity upon the petitioners, in case it is found that they have committed any wrong.
Order accordingly.
