Code of Civil Procedure, 1908 (V of 1908), Order 1 Rule 10 – Suit for specific performance – Impleadment as defendant -- Rights or interest of petitioners to the extent of their shares in suit land, are neither the subject matter of suit nor of the agreement to sell – Petitioners are neither necessary nor proper parties to the suit --  Petitioner cannot claim to be impleaded as party in the suit, where no relief is claimed against them – Law is settled that any decree against a stranger is nullity, therefore, any decree passed in the suit will have no effect on the rights of the petitioners.
