Indian Penal Code, 1860 (45 of 1860), Section 34, 302 -- Common intention in free fight case – Incident occurred after Panchayat proceedings -- Manner of occurrence and the number of injured on both sides makes it apparently a case of ‘free fight’ or spontaneous rather than pre-meditated crime – Nothing on record to show that the accused other than “S” had any knowledge or intention that “S” was going to cause death -- “S” was not carrying any gun when the Panchayat proceedings were going on – Other accused can be held liable for their individual act and cannot be held vicariously liable.
