Nullity of decree -- Decree passed by the appellate Court in favour of dead persons was a nullity, its invalidity can be raised even at the stage of execution

Code of Civil Procedure, 1908 (V of 1908), Section 96, Order 21 Rule 6, Order 22 Rule 2, 3, 6 -- Execution -- Decree passed in favour of dead persons -- Nullity -- Where appellants in a appeal died prior to the hearing of the appeal and their legal representatives were not brought on record, the judgment and decree passed in their favour is a nullity and has no force of law -- Consequently, the trial Court decree revives and is executable, and its invalidity can be raised even at the stage of execution.
