Negotiable Instruments Act, 1881 (26 of 1881), Section 138, 143A -- Bihar and Orissa Public Demands Recovery Act, 1914 (4 of 1914), Schedule I, Clause 3 – Code of Criminal Procedure, 1973 (2 of 1974), Section 421 -- Cheque bounce complaint -- Interim compensation – Recovery as public demand -- Whether an order for payment of interim compensation under the Negotiable Instrument Act can be enforceable under the Bihar & Orissa Public Demands Recovery Act, 1914 as a public demand? -- Interim compensation so ordered u/s 143A of the NI Act is recoverable as a fine u/s 421 of Cr.P.C. which then, clearly falls under the definition of ‘public demand’ – Held, interim compensation ordered under the NI Act falls within the ambit of Schedule I of the Recovery Act, realization thereunder cannot be stopped.
