1. Case taken up through video conferencing.
2. The petitioner is seeking regular bail in FIR No.78 dated 09.03.2019, under Sections 365, 379-B, 201 and 34 IPC, registered at Police Station City Rewari, District Rewari.
3. Learned counsel for the petitioner contends that the petitioner is not named in the FIR and has been arraigned as an accused on the basis of his disclosure statement after his arrest in another case. The allegations are that the car, mobile phone and Rs.200/- cash were snatched from the complainant. The petitioner is in custody for over 01 year and 04 months.
4. Learned State counsel states that the petitioner is in custody for over 01 year and 04 months. He further states that although the challan has been filed but none of the prosecution witnesses have been examined.
5. In view of the above, especially when the petitioner is in custody for over 01 year and 04 months, Covid 19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.
6. Therefore, without expressing any opinion on the merits of the case, the petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
Petition allowed.
