ANUPINDER SINGH GREWAL, J. (ORAL) –
1. The petitioner has sought a direction to the Family Court, Panchkula to expedite the proceedings of the petition under Section 20(3) of the Hindu Adoption and Maintenance Act filed by her.
2. Learned counsel for the petitioner submits that the petitioner, who is the daughter of the respondent, is studying undergraduate course in Medicine and Surgery from China and is in dire need of funds to sustain her education and living expenses. She had preferred a petition for maintenance along with an application for interim maintenance on 07.10.2021 which has not been decided till date. He, therefore, submits that the direction be issued to the Family Court to decide the application expeditiously.
3. Heard.
4. There appears to be merit in the contention of the counsel for the petitioner. The application for interim maintenance had been filed on 07.10.2021. The petitioner, who is pursuing her undergraduate course in Medicine and Surgery in China, would be requiring money for meeting her expenses and the application ought to have been decided expeditiously.
5. Consequently, the petition is allowed and the Family Court, Panchkula is directed to decide the application for interim maintenance expeditiously preferably within one month from the date of receipt of certified copy of this order.
Petition allowed.
