Motor Vehicles Act, 1988 (59 of 1988), Section 11, 166 – Central Motor Vehicles Rules, 1989, Rule 9 – Code of Civil Procedure, 1908 (V of 1908), Order 41 Rule 27 – Compensation in motor vehicle accident case – Accident by Oil Tanker -- Driver did not have a licence to drive a vehicle carrying dangerous and hazardous goods – Training certificate under MV Rules – Requirement of – Additional evidence in appeal -- No explanation for non-production of the certificate before the Tribunal; which was produced at the appellate stage for the first time -- Driver did not have a claim that he had undergone a training as prescribed under the Rules; despite being cross-examined on the point of absence of a valid license -- This raises genuine suspicion on the veracity of the certificate produced at the appellate stage – Direction issued to the insurance company to pay the amounts to the claimants and recover it from the owner of the oil-tanker, upheld.
