Constitution of India, Article 14 – Pay scale parity -- Discrimination – Employees appointed pursuant to a common competitive examination to identical posts and allocated to different departments purely by administrative allotment – Higher pay scale being given to others -- Principle of equality brooks no discrimination between persons who are similarly situated, and any differential treatment must be based on intelligible differentia having a rational nexus with the object sought to be achieved -- Fixation of different pay scales without intelligible differentia is arbitrary and violative of Article 14 – Ld. Single Judge of High Court directed the State to revise the pay scale – Direction upheld.
