ARVIND SINGH SANGWAN, J. (ORAL) –
1. Prayer in this 2nd petition is for grant of anticipatory bail to the petitioner in FIR No.64 dated 30.12.2019, registered under Sections 420 and 120-B IPC and 13 of the Punjab Travel Professionals (Regulation) Act, 2014 at Police Station Bholath, District Kapurthala.
2. Counsel for the petitioner submits that the new ground for filing this petition is that the matter has been compromised and the parties have settled their dispute.
3. Counsel for the complainant has filed the affidavit of the complainant – Manmohinder Singh, who has stated that, he has compromised the matter with the present petitioner.
4. Counsel for the State has also acknowledged the fact that the matter has been compromised.
5. A perusal of the record further show that even CRM-M No.37285 of 2020, has been filed praying for quashing of the FIR on the basis of the compromise in which on 12.11.2020, a direction has been issued to the parties to record their statements before the Illaqa Magistrate.
6. In view of the above, this petition is allowed and the petitioner is directed to appear before the Investigating Officer within a period of 10 days from today and she shall be released on interim bail on her furnishing bail/surety bonds subject to the conditions envisaged under Section 438(2) Cr.P.C.
7. Disposed of.
Petition allowed.
