Code of Criminal Procedure, 1973 (2 of 1974), Section 154, 482 -- Constitution of India, Article 21, 22 -- Indian Penal Code, 1860 (45 of 1860), Sections 419, 420, 406, 467, 468, 471 -- Two FIRs – Quashing of Second FIR – Abuse of process of law -- Second FIR nearly four years after the first FIR – Multiple FIR by the same person against the same accused for same set of facts and allegations is nothing but abuse of the process of law -- Act of the registration of such successive FIRs on the same set of facts and allegations at the instance of the same informant will not stand the scrutiny of Articles 21 and 22 of the Constitution of India – Appeal must succeed, FIR, charge sheet and the summoning order quashed and set aside.
