3. The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.0029 dated 20.02.2020, under Section 306 IPC, registered at Police Station Model Town, Ludhiana, District Ludhiana.
4. Learned State counsel, on instructions from ASI Sita Ram, states that the petitioner has joined the investigation and recovery has been effected. It is further stated that an affidavit of the complainant has also been filed recalling the earlier allegations and that he is not required as of now.
5. In view of the above, the present petition is allowed and the order dated 19.08.2020 is made absolute. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C.
Petition allowed.
