Negotiable Instruments Act, 1881 (26 of 1881), Section 118, 138, 139 – Code of Criminal Procedure, 1973 (2 of 1974), Section 401 -- Acquittal of accused -- Legal enforceable liability -- No direct transaction between the complainant and the accused-petitioner -- Entire story runs around the mother of the complainant, who is a vital witness, but she has not been produced and examined as a witness before the trial Court -- During obtaining loan from the bank, involvement of a third party witness was spoken by the complainant, but said person has not been examined as witness – Held, disputed question of facts and crucial persons like mother of the complainant and third party witness not being examined, conviction based on sole deposition of PW-1, the complainant, cannot be appreciated -- Complainant failed to establish "legally enforceable debt" -- Revision allowed, impugned judgment and order of sentence quashed.
