Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 (20 of 2015), Sections 3/13 (1), 8/13 (3) -- Code of Criminal Procedure, 1973 (2 of 1974), Section 439 – Cow slaughter case – Regular bail -- On secret information on raid petitioner alongwith 3 others was found slaughtering cows -- A freshly slaughtered cow alongwith 1 axe, 1 iron weighing scale and 2 kg. iron weight were recovered -- Without commenting anything on merit of case and also bearing in mind the investigation in the case is complete and the petitioner is in custody since 29.10.2020 and the trial of case has not made any headway, no useful purpose would be served by keeping him behind bars -- Petition allowed.

1. This is a petition filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 451 dated 29.10.2020 registered under Sections 3/13 (1), 8/13 (3) of Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Ferozepur Jhirka, District Nuh.
2. As per allegations in FIR, on receipt of secret information, a raid was conducted. The petitioner alongwith 3 others was found slaughtering cows. While 2 persons managed to escape, the petitioner and one Mohd. Saad were apprehended. A freshly slaughtered cow alongwith 1 axe, 1 iron weighing scale and 2 kg. iron weight were recovered.
3. The investigation in the case is complete, challan has been filed and charges have been filed against petitioner. Petitioner is in custody since 29.10.2020 and the trial of case has not made any headway.
4. Without commenting anything on merit of case and also bearing in mind the investigation in the case is complete and the petitioner is in custody since 29.10.2020 and the trial of case has not made any headway, no useful purpose would be served by keeping him behind bars. Hence, petition is allowed.
5. Petitioner is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate concerned.
Petition allowed.
