Service law – Promotion matter -- Violation of Statutory service rules -- Principle of estoppel and acquiescence – Applicability of -- Ld. Single Judge of High Court held, that the statutory rules would prevail and must be strictly adhered to and allowed the writ petition, directed the BHU to carry out the exercise for promotion afresh -- Whereas, the Division Bench proceeded to set aside the judgment applying the principle of estoppel and acquiescence over and above the eligibility conditions -- Appeal against -- Held, it is settled principle that principle of estoppel cannot override the law – There can be no estoppel against law -- If the law requires something to be done in a particular manner, then it must be done in that manner, and if it is not done in that manner, then it would have no existence in the eye of the law -- Appeals allowed.
