Compensation in motor vehicle accident case -- Failure to re-examine medically – High Court directed re-examination to know physical condition as on date -- Medical condition on the date of accident remains undisputed and was assessed to have suffered 9% disability qua whole body -- There is no challenge to this finding by the respondents -- If the claimant failed to get himself re-examined, no adverse inference can be drawn against him.

Burdon of proof -- If the owner-cum-driver of the car were setting up a defence plea that the accident was a result of not his but the other vehicle driver’s carelessness or rashness, then the onus was on him to step into the witness box and explain as to how the accident had taken place -- Fact that he chose not to depose in support of what he has pleaded in his written statement, further suggests that he was himself at fault.

FIR author not examined – Non-reporting of accident to police by eye-witness -- Eye witness (AW-3) accompanied deceased to hospital in his car -- It is quite natural that such a person who had accompanied the injured to the hospital for immediate medical aid, could not have simultaneously gone to the police station to lodge the FIR -- High Court ought not to have drawn any adverse inference against the witness for his failure to report the matter to Police.

License of driver – According to the owner the licence had been renewed but the endorsement is not signed by any officer -- There is no explanation why the licence was not taken back to the authorities for their signatures -- The official who had come from the Licensing Authority had stated that there was no record of renewal pertaining to this licence -- Driver-owner failed to step into the witness box and an adverse inference should be drawn against them.
