Section 62 – Constitution of India, Article 226 -- Banking default case -- One Time Settlement/ OTS – Extension of time – Writ jurisdiction -- Borrower as a matter of right cannot claim extension of time – By the impugned judgment and order rescheduling the payment under the OTS Scheme and granting extension of time would tantamount to rewriting the contract which is not permissible while exercising the powers under Article 226 of the Constitution of India – Impugned judgment/ order quashed and set aside -- Consequently, the original writ petition filed by the respondent/borrower stands dismissed.
