Accident dated 10.12.1998 -- Deceased-lady was a household lady aged about 45 years – Services rendered by a housewife cannot be less valued than what a daily wager can earn -- Considering the relevant facts the income of the deceased is assessed as Rs.1500/- per month -- Multiplier of '14' would be the appropriate multiplier -- Funeral expenses is enhanced to Rs.25,000/- -- An amount of Rs.1,00,000/- is awarded for loss of love and affection – Interest @ 7.5% per annum on enhanced amount from the date of filing the appeal till realization allowed.

Deceased lady was non-working -- Her notional income was taken as that of a home maker as Rs.5000/- -- After deducting 50% towards the personal expenses of the deceased the annual income came to be Rs.30,000/--- Age of the deceased was 60 years -- After applying the multiplier of 9, the compensation came to Rs.2,70,000/- -- An amount of Rs.1,00,000 was awarded for loss of love and affection for the claimants and an amount of Rs.25,000/- was awarded for funeral expenses of the deceased -- The total compensation came to Rs.3,95,000/- -- Award held to be rightly passed.

Accident of 1990 – Income of deceased as House-wife taken as Rs.3,000/- p.m. -- Deducting 1/3rd for personal expenses contribution of the deceased and the family is calculated at Rs.2,000/- per month -- Deceased was aged about 22 years, proper multiplier to be adopted is 18 -- Dependency is calculated at Rs.4,32,000/- (Rs.2000 x 12 x 18) -- Rs.1,00,000/- is awarded towards loss of consortium and Rs.1,00,000/- towards loss of love and affection to the minor children -- Towards loss of estate and funeral expenses, award of compensation of Rs.15,000/- awarded by the High Court is maintained -- Thus, the claimants are entitled to a total compensation of Rs.6,47,000/- alongwith 9% interest p.a.

Assessment of income -- Deceased was a housewife and a home maker – It is hard to monetize the domestic work done by a house-mother -- Services of the mother/wife is available 24 hours and her duties are never fixed -- Courts have recognized the contribution made by the wife to the house is invaluable and that it cannot be computed in terms of money -- A house-wife/home-maker does not work by the clock and she is in constant attendance of the family throughout and such services rendered by the home maker has to be necessarily kept in view while calculating the loss of dependency -- Taking deceased as the home maker, it is reasonable to fix her income at Rs.3,000/- per month.
